When Kaiser opened its own kidney transplant program in 2004 in Northern California, hundreds of Kaiser patients waiting for their new kidneys were never properly transferred from their places on existing wait lists at UC Davis and UC San Francisco, causing them to be completely dropped from the wait list or moved to the end of the line.

According to a wrongful discharge lawsuit filed by David Merlin, the former head of the Kaiser Permanente kidney transplant unit, Kaiser's "program was so poorly organized and unprofessionally managed that it failed to comply with state and federal requirements and was compromising patient care, leading to unnecessary suffering and possibly deaths." Merlin alleges he was fired after repeatedly complaining about the sad state of Kaiser's kidney transplant unit.
